Where did this document? I recall the background. Start the development of a national standard examination was given in 2015 at a round table in the Central scientific-реставрационных workshops. June 26, 2016 with the creation of the text of the standard have engaged in a specially formed working group, operating under the auspices of the Technical Committee No. 082 (Cultural heritage) at the Rosstandart. Project developers in the first edition of the text is specified by three structures: the Federal state unitary enterprise "Central scientific-реставрационные design workshops", FGBUK "all-Russian art scientific-реставрационный centre named after academician I. E. Grabar" and ANO "Center of independent expertise". But in fact, the discussion and development of relevant sections of the standard have engaged in about two dozen experts and representatives of a much larger number of interested organizations, among which were Igor Kudimov (ANO "Center for independent evaluation"), Elena Piskunova (Russian state University of justice), Olga Glebova (NINE them. P. M. Tretyakov), Anna Kiseleva Rudolfovna (GRC them. academician I. E. Grabar), Natalia Ignatova (NINE them. P. M. Tretyakov), Irina Kolosova (Institute of Art-бизнеса and Antiques), Mikhail Efremovich perchenko (MKAAD), Vladimir Bogdanov (ARTinvestment.RU) and many others. Work on the sections of the text was carried out in groups all summer of 2016. As a result, in late August, all sections were United in a common document, which was sent in Rosstandart to provide for public discussion.
That offers a new standard of examination of works of art? Than "gostovskaya" the examination will be different from the one that is now?
In my estimation, no radically new, complex and time-consuming requirements to the expert community standard does not show. And understandably so: the text of the relevant sections wrote themselves practicing experts; they walked along the already trodden path, wishing to strengthen the standard of their usual examination procedure and approval. Additional stress for yourself, the experts tried to avoid, sometimes much to the dismay of other team members.
From my point of view, the first version of the draft standard has two main gains.
the First conquest is that finally-то in the standard fixed base requirements as to the form and structure of a document called "Expert opinion". Section 8 lists specific information that must be contained in the paper that the client receives (customer expertise) on hand. This is not a strict form, but the list is quite a specific requirement. The standard will not allow to forget about the date of issuance of the conclusion, it is wrong to specify the size, to prevent the lack of phones for authentication, encapsulation, etc. It specifies requirements for the description of the history of existence (provenance) studied painting or drawing. In General, azstandart takes a lot of "interpretations" and protects against possible negligence, which later create problems for the owners of works of art, as well as complicate the work of gallery owners and organizers of auctions.
of Course, even if you observe for examination all items of GOST, it does not guarantee the correctness of the main conclusion on the question of authenticity. But at least on formal grounds to find fault with this conclusion or challenge it in court will be difficult.
the re-conquest of the standard — is the duty to inform the customer about the absence or the presence of contractor's insurance policy for personal responsibility. The current version of this requirement is contained in section 5 and formulated literally so: "At the conclusion of the contract, the contractor shall in writing inform the customer about the presence or absence of the contract of insurance of professional liability of expert(s) (s) is (-ут) to carry out the examination provided by the customer object. When discussing repeatedly requested to specify the validity period of the policy. However, in the current revision, this requirement is not explicitly included. Initially to the question of insurance has suggested to approach more radically: to introduce compulsory professional liability insurance experts. That was in France. For the sake of peace sellers, buyers, first and foremost the experts themselves. But this proposal ran into legal restrictions (the introduction of compulsory insurance requires decisions at a higher level, industry standard is overwhelming) and to my surprise, the resistance of the representatives of the expert community. That is, the idea of insurance is not like just that, who are these policies supposed to protect. I think this is a mistake. But apparently the time has not come yet. Besides, nobody forbids experts to insure voluntarily.
which we now stage and what is planned next? the First edition 28 August 2016 entered technomate Rosstandart "Cultural heritage" (TK 82). This point can be considered the beginning of public discussion. Until 28 October 2016 all interested persons and organizations may send their comments to the addresses irina29cnrpm@yandex.ru and kochegarov_200950@mail.ru. It is assumed that this time is enough to draft standard examination time to review and comment on the international Confederation of antique and art-дилеров, expert organizations and all market participants affected by innovations of standard. After October 28, probably closer to mid-November, will again convene a working group to examine the comments received and will make adjustments in the text. After that, the corrected text will be sent for examination in VNIIS — national Institute for certification. Only after the conclusion of VNIIS the text of the draft will return to the Rosstandart to further official publication. In short, the process is still long, but the time to send comments just over a month.
an Important point that should be noted: the use of national standard examination — voluntary. Experts, including accredited MKAAD, and then will be able to operate without a standard, they are used to. Can write expert opinions in an arbitrary manner, with his seal, in his scheme, as before. To insure the liability they, too, will not make one, even if they decide to work according to GOST. As already mentioned, the expertise it is possible to do azstandart, but without insurance. In General, knowledge of the standard will need only in cases when the requirement to do the examination according to GOST presenting the customer. And then really the expert to decide: agree to work in accordance with this document or not.
