“Portrait of young man” Oskar Kokoschka not give restitution

District Court of Louisiana denied a citizen of Austria Claudia Zeger-Tomshits (Claudia Seger-Thomschitz) to return to her picture of the great expressionist artist Oskar Kokoschka (Oskar Kokoschka). Cloth «Portrait of young man (Hans Reichel)», written in 1910, belongs to Sarah Blodgett Dunbar (Sarah Blodgett Dunbar), whose mother, Sarah Blodgett Platt (Sarah Blodgett Platt), acquired it in New York Galerie St. Etienne.

Zeger-Tomshits claims to be the heir of the deceased in 1997 Raymundo Reichel (Raimund Reichel). His father, the Viennese art dealer of Jewish origin Oskar Reichel (Oskar Reichel), in 1939, gave a picture of Otto Kalliru (Otto Kallir), founder of the gallery. Seven years later bought the work of Sarah Blodgett Platt. Since the 1970's «Portrait of young man» on display at the Art Museum of New Orleans.

According to Zeger, Tomshits, Oskar Reichel was forced to sell the painting under pressure from the Nazis, so the legal owners Kallir and, accordingly, Platt and her daughter can not be considered. However, the Court is not persuaded by her arguments. Reichel is not simply left on deposit with the art dealer - he got it for the money and handed Kalliru ownership. In addition, after the war, the son Reichel has been active in finding lost property during the Holocaust, his family, but the picture Kokoschka, he has not tried to return.

Zeger-Tomshits also tried to win back at the Art Museum of Boston, another piece from the collection of Kokoschka Reichel, picture, entitled «Two nude (Lovers)». Like the «Portrait of young man», the work formerly owned by Sarah Blodgett Platt, as it was before - Otto Kalliru that Reichel has brought her to sell. In May the court of Massachusetts ruled that Zeger-Tomshits may not qualify for the picture, because there is no documentary evidence that Kallir had no right to dispose of it as their own property. When the dealer sold the work, he sent the proceeds sons Reichel. After the war, they never stated that it would return.
